What a Postnuptial Agreement Can Cover

A postnuptial agreement can address the financial dimensions of a marriage with considerable detail. Common terms include division of real estate, vehicles, investments, and business interests; allocation of responsibility for specific debts; and whether either spouse will pay spousal maintenance if the marriage ends. Under 750 ILCS 5/503(a)(4), property excluded from the marital estate by a valid agreement is treated as non-marital property, which gives a well-drafted postnuptial agreement significant legal effect. Without one, Illinois courts divide marital property under an equitable distribution standard, meaning fairly but not necessarily equally.

There are firm limits on what a postnuptial agreement can decide. Child custody, parenting time, and child support can’t be predetermined by contract. Illinois courts decide those issues based on the child’s best interests at the time of separation or divorce, and no private agreement between spouses can override that standard.

Enforceability Requirements Under Illinois Law

Illinois has no standalone postnuptial agreement statute. These agreements are enforced under general contract law and the heightened fiduciary duty spouses owe each other once married, which is why courts scrutinize them more closely than prenuptial agreements.

For a postnuptial agreement to be enforceable, several requirements must be met:

• Written and signed: Both spouses must sign. Oral agreements aren’t enforceable.
• Voluntary execution: Neither spouse can sign under duress, coercion, or undue influence.
• Full financial disclosure: Both spouses must accurately disclose their assets, debts, and income at the time of signing.
• Separate consideration: Unlike a prenuptial agreement, where the promise to marry serves as consideration, a postnuptial agreement requires an independent exchange of something of value between spouses.
• Fairness at signing: A court won’t enforce terms that are unconscionable, meaning grossly unfair, at the time the agreement was made.

Independent legal counsel for each spouse isn’t strictly required by statute, but it can strengthen the agreement’s position if it’s challenged later.

Why Married Couples Consider a Postnuptial Agreement

Financial circumstances change during a marriage, and a postnuptial agreement is one way couples address those changes directly. An inheritance, the launch of a new business, a significant career change, or the acquisition of substantial new assets can all prompt couples to clarify how those assets would be treated if the marriage ended. Some couples use a postnuptial agreement specifically to protect a family business or professional practice from division in a future divorce.

A postnuptial agreement can also amend an existing prenuptial agreement. Under 750 ILCS 10/6 of the Illinois Uniform Premarital Agreement Act, the way to change a prenup during marriage is through a signed written agreement, which functions as a postnup. Separately, couples working through a difficult period sometimes find that setting clear financial terms in writing is a constructive part of reconciliation.
